Court orders JPD to return seized vehicle to owner

Less then a week after our client purchased a Cadillac, the Joliet Police Department arrested her and tried to forfeit the car, claiming it was used to facilitate drug activity. Attorney Joe Namakis, combining his knowledge of civil and criminal law, successfully argued to the Court that there was insufficient evidence to demonstrate that a forfeitable offense took place. Despite the State’s efforts to convince the judge that the evidence was sufficient, the Court found that the State had not met its burden of proof and ordered that the car be released back to the owner.
